Terms of Service

Car MAIT helps run workshop administration. The workshop remains responsible for mechanical work, prices, customer consent and reviewing records before they are sent. During a free pilot, either side can stop at any time.
1. Agreement and authority
These Terms are between Car MAIT (“Car MAIT”, “we”, “us”) and the workshop business creating or accepting an account (“you”). The person accepting confirms they are authorised to bind the workshop. These Terms begin when an owner accepts them or uses the service.
You must provide accurate account details and keep login credentials secure. Owner accounts control team access and must promptly disable access that is no longer authorised.
2. The service
Car MAIT provides tools for workshop administration, including bookings, scheduling, service records, approvals, parts, quotes, invoices, payments recorded by the workshop, receipts and customer communications. Car MAIT does not perform mechanical work, inspect vehicles, process a workshop’s customer EFTPOS payment, or guarantee a repair outcome.
Features may change as the product develops. We will not materially reduce a paid core service without reasonable notice. Pilot features may be incomplete, changed or withdrawn.
3. Your responsibilities
You are responsible for the accuracy of workshop records; mechanical diagnosis and workmanship; pricing, taxes and invoices; obtaining customer consent; reviewing AI-assisted or dictated content; lawful messaging; supplier orders; backups or exports reasonably needed for your business; and compliance with motor trade, consumer, employment, tax and privacy laws.
You must not use Car MAIT unlawfully, access another workshop’s data, upload malicious code, interfere with security, send spam, share credentials, or use the service to mislead a customer. You must have authority to enter customer, staff and vehicle information.
4. Customer data and privacy
You retain ownership of content and business records you enter. You grant Car MAIT the limited right to host, process, back up and transmit that data only to provide, secure and improve the service, comply with law, and follow your authorised instructions. Our Privacy Policy explains our handling practices.
We do not sell workshop customer lists. De-identified and aggregated information may be used to understand reliability and product usage, provided it does not reasonably identify a workshop customer or reveal one workshop’s records to another.
5. Pilot, trial, fees and cancellation
A stated free pilot or trial does not require a payment card and may be ended by either side at any time. Paid pricing, currency, billing period and applicable GST are shown before purchase. Car MAIT does not take a percentage of workshop customer payments.
For paid subscriptions, you may cancel before the next renewal to stop future charges. If we propose a material price change, we will give reasonable advance notice and you may cancel before it takes effect. Nothing in these Terms removes refund or remedy rights that cannot lawfully be excluded.
6. Availability, support and changes
We aim to keep the service available and to address faults with reasonable care and skill, but internet services may experience maintenance, provider failures or interruptions. During a pilot there is no guaranteed uptime or response-time service level. We will use reasonable efforts to restore material failures and protect stored data.

7. Suspension and termination
We may suspend access where reasonably necessary to address a security risk, unlawful use, material non-payment or a material breach. Where practicable, we will give notice and an opportunity to fix the issue. We will not use suspension to avoid our obligations or unfairly prevent access to business data.
You may stop using the service or request closure. Where reasonably available, export your records before closure. We may retain limited records where legally required. Provisions about confidentiality, ownership, accrued payments, liability and disputes survive termination where relevant.
8. Intellectual property and feedback
Car MAIT and its software, branding and documentation remain ours or our licensors’. You may use them only to operate your subscribed workshop account. You may give product feedback; we may use that feedback without restriction or payment, but we will not publicly identify you without permission.
9. Liability and legal rights
Each party is responsible for loss it causes through fraud, wilful misconduct, breach of confidentiality or privacy duties, or other liability that cannot lawfully be limited. To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable.
Any other aggregate liability of Car MAIT relating to a paid service is limited to fees paid for that service in the 12 months before the event giving rise to the claim. This cap does not apply where prohibited by law. These Terms do not exclude the New Zealand Consumer Guarantees Act, Fair Trading Act, Australian Consumer Law, privacy law, or any mandatory small-business protection where it applies.
10. Disputes, law and changes
Please contact us first so we can try to resolve a dispute in good faith. New Zealand law governs these Terms, but mandatory Australian or other local laws continue to apply where they cannot be excluded. Courts with lawful jurisdiction may hear unresolved disputes.
We may update these Terms for legal, security or service changes. We will give reasonable notice of material changes. If a material change disadvantages you, you may stop using the service before it takes effect without a new cancellation penalty.
